Woman shot by Border Patrol agent during Midway Blitz sues the federal government

Marimar Martinez, a Chicago woman shot five times by a Border Patrol agent during Operation Midway Blitz in October 2025, filed a lawsuit against the federal government Monday, WGN reports. The Department of Homeland Security had accused her of trying to ram agents with her vehicle and charged her, but the Justice Department later dropped all charges.

Her attorneys said there has been no investigation or charges against the agent, Charles Exum, and presented new video and photo evidence they say shows he was not in harm’s way when he fired. Martinez says she was driving away when shots hit her vehicle. She filed an administrative Federal Tort Claims Act complaint in February, the first step toward a suit.
